01Acceptance of Terms
By ordering or using CXL Dialers services — dialer hosting, VoIP, DIDs or support — you agree to these terms on behalf of your organisation. If you do not agree, do not use the services.
02What We Provide
We provision and manage VCDial dialer instances, provide SIP trunking and DID numbers over our carrier relationships, and support both. Setup targets one hour from kickoff call to a live test call; the one common exception is number porting from another provider, where timing is controlled by the losing carrier and communicated to you upfront.
03Your Telecom Compliance Obligations
You are responsible for how you dial. That includes do-not-call list scrubbing, calling-hour restrictions, abandoned and drop-rate limits, consent for automated dialing, caller ID accuracy, and recording-consent laws in every jurisdiction you call into. We configure the platform to support your compliance program and will help you set the relevant controls, but we do not provide legal advice and we are not responsible for your campaigns. Regulations differ substantially by country and by state — get counsel who knows yours.
04Acceptable Use
The services may not be used for fraudulent, deceptive or illegal calling, caller ID spoofing intended to mislead, traffic pumping, or any activity that violates carrier terms or telecom regulation. Traffic that triggers carrier abuse complaints or regulatory action may be suspended immediately to protect the platform and our other customers. Where circumstances allow, we will contact you before suspending.
05Your Data & Ownership
Your leads, call recordings, dispositions and reporting are yours. We hold them on your behalf, we do not sell or mine them, and we do not use them for training. You can export everything at any time. If you leave, we provide a full export rather than treating your data as leverage — see our Privacy Policy for details.
06Availability & Support
We target 99.9% platform availability and monitor continuously, with carrier failover configured. Support is staffed 24/7 through the channel agreed with your team. Planned maintenance is scheduled outside your peak dialing hours where possible and announced in advance. Carrier-side outages and upstream network failures are outside our direct control, though rerouting around them is exactly what our support exists to do.
07Pricing & Billing
Pricing is quoted per engagement based on seats, concurrency, regions, minutes and add-ons. Quotes state clearly what is included. There is no setup fee and no minimum contract term; you can scale seats up or down and we reprice accordingly. Invoices are payable on the terms stated on the invoice, and services may be suspended for accounts significantly overdue after notice.
08Termination
Either party may terminate with the notice period stated in your agreement. On termination we provide a full export of your data and keep it available for an agreed handover window before deletion. We do not hold data hostage as a retention tactic.
09Limitation of Liability
Services are provided on a commercially reasonable basis. CXL Dialers is not liable for indirect, incidental or consequential losses, including lost revenue or lost business opportunity arising from downtime, dropped calls or carrier issues. Our total aggregate liability is limited to the amount you paid us in the twelve months preceding the claim. Nothing here limits liability that cannot lawfully be limited.
10Changes to These Terms
We may update these terms as the service evolves. Material changes are communicated to customers directly, and continued use after the stated effective date constitutes acceptance.
